Terms of service
Recovery Warehouse HQ · Legal
Terms of Service
Effective September 15, 2026 · Revised September 29, 2026
1 · Introduction
Welcome to Recovery Warehouse HQ. This website is operated by Recovery Warehouse HQ ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of our website at recoverywarehousehq.com ("Website") and any related services (collectively, the "Services"). By accessing or using our Services you agree to be bound by these Terms. If you do not agree, please do not use our Services.
2 · Eligibility
By using the Services you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
3 · Accounts and Checkout
You do not need an account to buy from us. Guest checkout is available on all orders. Where you choose to create an account, you agree to provide true, accurate and current information during registration, to keep that information up to date, to maintain the confidentiality of your login credentials, and to notify us immediately of any unauthorised use of your account.
We may suspend or close an account where these Terms are breached, or where we reasonably suspect fraudulent activity.
4 · Orders, Pricing and Payment
4.1 Product Availability
All products are subject to availability. Many of our saunas, plunge systems and chillers are built to order, and lead times vary by model, configuration and season. We reserve the right to limit the quantities of any product or service we offer.
4.2 Pricing
Prices are subject to change without notice. Prices in effect at the time you place an order apply to that order. We are not liable for price changes, modifications or discontinuation of products.
4.3 Payment Terms
Accepted payment methods are displayed at checkout and are processed securely through Shopify Payments. You agree to provide current, complete and accurate billing information, and to pay all charges incurred under your account or order.
4.4 Order Acceptance
We reserve the right to refuse or cancel any order, including where:
● A product is unavailable or cannot be built within a reasonable period
● There is an error in the description or price of a product
● We suspect fraudulent or unauthorised activity
Where we cancel an order under this section, we will refund any amount already paid for that order.
5 · Shipping, Delivery and Risk
5.1 Shipping Policy
Shipping times, costs, freight procedures and unloading requirements are set out in our Shipping Policy, which forms part of these Terms. Because many orders ship as heavy freight, please read it before ordering — particularly the sections on site access and unloading responsibilities.
5.2 Risk of Loss and Title
Risk of loss passes to you upon delivery to the delivery address, not upon dispatch. Title to the goods passes to you upon delivery and receipt of payment in full.
The carrier is acting on our behalf until the goods are delivered. If your shipment arrives damaged, the inspection and reporting procedure in our Shipping Policy and Return & Refund Policy governs how the claim is handled. That procedure matters: damage notated on the carrier's Bill of Lading at delivery is substantially easier to resolve than damage reported after the fact.
This section does not affect any rights you have under applicable consumer protection law.
6 · Returns and Refunds
Returns, cancellations and refunds are governed by our Return & Refund Policy, which forms part of these Terms. In summary: accessories and freight orders are final sale; claims for shipping damage, missing components or verified manufacturer defect are handled under the reporting windows and assessment process set out in that policy.
7 · Product Warranties
Many products we sell carry a manufacturer's warranty — for example, the 5-year limited warranty offered by Dundalk LeisureCraft on their Canadian Timber sauna range. Product warranties are separate from, and are not affected by, the disclaimers in Section 10. Warranty terms are set by the manufacturer, apply only to verified defects in materials or workmanship, and are assessed at the manufacturer's discretion. Warranty coverage does not extend to normal wear, misuse, improper installation, or damage in transit.
8 · Intellectual Property Rights
8.1 Ownership
All content on the Website — text, graphics, logos, images and software — is the property of Recovery Warehouse HQ or its content suppliers and is protected by intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial purposes.
8.3 Restrictions
You agree not to:
● Reproduce, duplicate, copy, sell, resell or exploit any portion of the Services without our express written permission
● Use any meta tags or hidden text incorporating our name or trademarks without express written consent
9 · User Content
9.1 Submissions
If you submit or post content to the Services — including product reviews, photographs and comments — you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify and display that content in connection with our business. You confirm that you own or control the rights to what you submit.
9.2 Prohibited Content
You agree not to submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene or invasive of another's privacy, or that infringes the intellectual property or other proprietary rights of any party.
10 · Disclaimers and Warranties
10.1 Website Provided "As Is"
The Website and Services are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the Website itself.
10.2 No Warranty as to Website Availability
We do not warrant that:
● The Website will meet your specific requirements
● The Website will be uninterrupted, timely, secure or error-free
● Any information obtained from the Website will be accurate or reliable
10.3 Product Warranties
Nothing in Section 10 limits the manufacturer's warranties described in Section 7, or any statutory rights you hold under applicable consumer protection law.
11 · Limitation of Liability
To the fullest extent permitted by law, Recovery Warehouse HQ, its directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the Services; unauthorised access to or use of our servers or any personal information stored therein; or any interruption or cessation of transmission to or from the Services.
Nothing in this section excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
12 · Indemnification
You agree to indemnify, defend and hold harmless Recovery Warehouse HQ and its affiliates from any claims, damages, obligations, losses, liabilities, costs or debt arising from your use of and access to the Services, your violation of any term of these Terms, or your violation of any third-party right, including intellectual property or privacy rights.
13 · Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, if you breach these Terms. Provisions that by their nature should survive termination — including Sections 8, 11 and 12 — will survive.
14 · Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions.
15 · Dispute Resolution
Informal resolution
If a dispute arises between you and us, both parties agree to first attempt to resolve the matter informally. You may contact our support team at support@recoverywarehousehq.com within 30 days of the issue arising.
Mediation and arbitration
If the dispute cannot be resolved informally, both parties agree that it will be settled by binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in Nevada, and the arbitrator's decision will be final and binding.
Class action waiver
You agree that any dispute will be resolved individually, and not as part of any class action, consolidated or representative proceeding.
Exceptions
Either party may bring a claim in small claims court if eligible, or seek injunctive relief for alleged infringement or misuse of intellectual property rights.
If you are a consumer resident in a jurisdiction whose law gives you the right to bring proceedings in your local courts, nothing in this section removes that right.
16 · Changes to These Terms
We reserve the right to modify or replace these Terms at any time. Changes take effect when posted to the Website with a revised effective date. It is your responsibility to review these Terms periodically. Continued use of the Services after changes are posted constitutes acceptance.
17 · Miscellaneous
17.1 Severability
If any provision of these Terms is found unenforceable or invalid, the remaining provisions remain in effect.
17.2 Entire Agreement
These Terms, together with our Shipping Policy, Return & Refund Policy and Privacy Policy, constitute the entire agreement between us regarding the Services and supersede any prior agreements.
17.3 Waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right.
